Terms and Conditions of Use for Otzar HaYam Cosmetics Website

1. General Provisions

1.1. These Terms and Conditions (hereinafter – "the Terms") govern the use of the website otzarhayam.co (hereinafter – "the Site"), which belongs to George Raskin (Osek Patur / Exempt Dealer) (hereinafter – "the Company" or "the Seller").

1.2. Use of the Site, including browsing, registration, and making a purchase, constitutes your full and unconditional acceptance of these Terms. If you do not agree to any provision of the Terms, you are not authorized to use the Site.

1.3. The Company reserves the right to amend the Terms at any time. Changes take effect upon their publication on the Site.

2. Products and Information

2.1. The Site offers for sale handcrafted personal care cosmetics, including bath bombs, shower gels, soaps, scrubs, and other products (hereinafter – "the Products").

2.2. Ingredients and Usage: All information regarding the composition, properties, and method of use for the Products is detailed on the relevant product page. As the Products contain natural ingredients, the buyer is obligated to perform a patch test on a small area of skin before the first use, to rule out an allergic reaction.

2.3. Photos and descriptions of the Products on the Site are for illustrative purposes only. Due to the handcrafted nature of the production and the use of natural ingredients, the color, shape, and aroma of the actual Product may slightly differ from the image presented.

2.4. The purchase of Products is permitted only to persons aged 18 and over.

3. Order Placement and Payment

3.1. An order is considered placed after the Buyer has filled in all required fields, selected the shipping and payment method, and received an order confirmation from the Seller via email.

3.2. Prices: All prices on the Site are listed in New Israeli Shekels (₪) and include VAT, where legally applicable.

3.3. Payment Methods: Payment can be made via PayPal, Credit Cards (Visa, MasterCard, American Express, etc.), and the Bit payment system.

3.4. The Seller has the right to cancel an order or part of it in the event that the Product is out of stock or cannot be manufactured. In this case, the Buyer will be offered an alternative Product or a full refund.

4. Shipping

4.1. Order Processing Time: Orders are typically processed and handed over for shipping within 3–5 business days from the receipt of payment.

4.2. Cost and Shipping Methods within Israel:

Israel Post (Standard Post): The shipping cost is 30 ₪. The estimated delivery time is 4–10 business days from the date of dispatch.
Courier Delivery (Door-to-Door): The shipping cost is 50 ₪. The estimated delivery time is 1–2 business days from the date of dispatch.
Free Shipping: Provided for orders totaling 700 ₪ or more.

4.3. Delivery times are estimates only. The Seller is not responsible for delays caused by third parties (postal services, couriers).

4.4. The risk of accidental loss or damage to the Product transfers to the Buyer at the moment the Product is handed over to the courier or postal service.

5. Transaction Cancellation, Returns, and Exchanges

5.1. The Buyer has the right to cancel the transaction in accordance with the Israeli Consumer Protection Law, 5741-1981.

5.2. Product Returns: As the Product is a cosmetic item and subject to personal hygiene, returns are possible only under the following conditions:

The Product must be returned within 14 days of receipt.
The Product must be in its original, undamaged packaging and must not have been used. Breach of the original packaging or use of the product renders it non-returnable for hygiene reasons.
The Buyer bears the cost of return shipping.

5.3. Damaged Product: If the Product was received damaged during the shipping process, the Buyer must notify the Seller within 24 hours of receipt, attaching photos of the damage. The Seller commits to sending a replacement at their own expense.

5.4. Refunds: Refunds will be processed within 7 business days from the date the returned Product is received and inspected, using the same method by which the payment was made.

6. Privacy

6.1. Use of the Site is governed by the Privacy Policy published on the Site.

6.2. The Seller undertakes to use Buyers' personal information exclusively for the purpose of processing orders, improving service, and direct marketing (if the Buyer has consented to this).
